AN ORDINANCE PERTAINING TO COIN-OPERATED AMUSEMENT DEVICE LICENSES; AMENDING THE LICENSE FEES; AMENDING SECTIONS 5-13 AND 5-15 OF THE DULUTH CITY CODE, 1959, AS AMENDED.
BY COUNCILOR EDWARDS:

The city of Duluth does ordain:

Section 1. That Section 5-13 of the Duluth City Code, 1959, as amended, be amended to read as follows:

Sec. 5-13. Coin-operated device authorization card fee.

The annual fee for each coin-operated device authorization cards shall be $30 $15 for each card plus $15 for each location where coin-operated devices are located. If a coin-operated device authorization card is issued for a lesser term than one year, the fee for the same shall be computed at the rate of $2.50$1.25 per card for each calendar month.

Section 2. That Section 5-15 of the Duluth City Code, 1959, as amended, be amended to read as follows:
Sec. 5-15. Same--Supplier's license fee.

The annual fee for a supplier's license shall be $500 $10.

Section 3. That this ordinance shall take effect and be in force 30 days from and after its passage and publication.



STATEMENT OF PURPOSE: In Laws of Minnesota, 1999, Chapter 179, the State Legislature passed a statute limiting the amount of license fees that any city in Minnesota can charge on coin-operated amusement devices. Duluth's fees were higher than the statute allowed and computed on a different basis than the statute provided for (Duluth had no per location fee). This ordinance amendment makes Duluth's system compliant with the statute.
