A CONTRACT WITH ENVIRONMENTAL TROUBLESHOOTERS FOR REMEDIATION AND COST
RECOVERY ASSOCIATED WITH THE PIONEER BUILDING SITE IN AN AMOUNT NOT TO

BE IT RESOLVED, that the
proper city officials are authorized to execute and implement a contract
with Environmental Troubleshooters, for a cost not to exceed $17,745, in
the form and containing the terms and conditions set out in the contract
on file with the city clerk as Public Document No. _____________, for remediation
and cost recovery associated with the Pioneer building site, payment to
be from Self Insurance Fund 605-036-1650-5319.
OF PURPOSE: In 1975, the city experienced a leak in an underground
tank at city hall. In the 1980's, the city operated a fueling facility
at the government services building. The soil under the Pioneer building
became contaminated with fuel, and the owner and MPCA brought action against
the city and state. As part of the settlement, reached several years ago,
the city must operate and maintain a monitoring and filtering system at
the site. The original contractor went out of business. We received complaints
of fuel fumes in the building. This led us to discover that the filter
system is broken. This contract provides for repair and maintenance, on-going
monitoring and testing the MPCA requires and cost recovery from the state
petrofund. Most of the costs are eligible for reimbursement from the petrofund.
The maximum level is 90%. We may not be approved for 90%, but we will receive
significant reimbursement of this contract cost, over 50%. The necessary
applications have already been submitted.
