AN ORDINANCE AUTHORIZING RESALE OF CERTAIN PROPERTY IN GARY-NEW DULUTH TO THE STATE FOR RESALE TO ADJACENT OWNER.
BY PRESIDENT GILBERT:

The city of Duluth does ordain:

Section 1. That the proper city officials are hereby authorized to sell and convey the following described property in St. Louis County, Minnesota, by quit claim deed, to the state of Minnesota to allow resale to an adjacent property owner, and execute all documents necessary with regard to said conveyance:

Lots 1 and 2, and Lots 23 and 24, Block 9, Pittsburgh Addition.
Section 2. This ordinance shall take effect 30 days from and after its passage and publication.


STATEMENT OF PURPOSE: The purpose of this ordinance is to authorize the reconveyance of four tax forfeit lots in Gary-New Duluth, west of the old Cement Plant, to the state of Minnesota so that they can be sold to an adjacent property owner.

The city originally acquired this property in 1973 pursuant to a free conveyance from the state for the limited purpose of using it in conjunction with the yet-to-be-constructed Spirit Mountain Recreation Area. As that facility has developed, however, it has become clear that this property will not be necessary in the reasonably foreseeable future for Spirit Mountain's needs.

In the mean time, Mr. Kevin Hinnencamp acquired the property adjacent to the property in question. His home is located on this adjacent property and he would like to acquire the property in question in order to construct a garage and to expand his yard. Allowing him to purchase this property would also result in unneeded property going back on the tax roles.

In order to accomplish this, the city must re-convey its interest in the property to the state so that the state, in turn, can sell the property, under its normal procedures, to Mr. Hinnencamp. This ordinance would accomplish this end. This resale to the state has been approved by the planning commission.
