RESOLUTION AMENDING AN AGREEMENT WITH FRYBERGER, BUCHANAN, SMITH & FREDERICK FOR LEGAL SERVICES NECESSARY TO ACCESS A $1.3 MILLION STATE GRANT FOR THE LAKE SUPERIOR ZOO, INCREASING THE AMOUNT BY $2,050.
BY COUNCILOR NESS:

WHEREAS, the state of Minnesota has appropriated $1,300,000 for a grant to the city for capital improvements to the Lake Superior Zoological Garden; and

WHEREAS, the city contracted with Fryberger, Buchanan, Smith & Frederick by purchase order for $4,950 to perform necessary legal services to accept said grant; and

WHEREAS, it appears grant acceptance will require more hours of legal work than are funded in the initial contract.

NOW, THEREFORE, BE IT RESOLVED, that the contract with Fryberger, Buchanan, Smith & Frederick entered into pursuant to Purchase Order No. 98-0922-5568 be amended to increase the compensation by $2,050 to a total of $7,000, said funds to be drawn from Fund 450, Agency 015, Org. 1998, Object C813.



STATEMENT OF PURPOSE: This resolution increases the funding in a legal services agreement with the Fryberger law firm from $4,950 to $7,000 to cover legal expenses in accepting the 1.3 million dollar state grant for the zoo. The city originally contracted these legal services under the $5,000 council approval amount when the state's and processing requirements were unknown. It was anticipated at a later date that the city council would need to approve the subsequent higher amendment. Now that the city is close to completion of the state grant process, the final amount of $7,000 will be sufficient to complete the project. Legal costs related to the grant are paid from the grant.
