AN ORDINANCE AUTHORIZING THE RECOVERY OF FEES BY THE DULUTH PUBLIC LIBRARY THROUGH THE UTILIZATION OF THE STATE REVENUE RECAPTURE ACT; AMENDING SECTION 2-17 OF THE DULUTH CITY CODE, 1959, AS AMENDED

The city of Duluth does ordain:

Section 1. That Section 2-17 of the Duluth City Code, 1959, as amended, be amended to read as follows:

Sec. 2-17. Library operations and services; fees.

The department of libraries may charge user fees, rental fees and penalties in conjunction with the operation of the public library system including, but not limited to, penalties for overdue materials, rental fees for library meeting rooms and the use of library equipment, and nonresident user fees. Types of fees charged and the amounts of the fees shall be set by council resolution. The department of libraries may, in the collection of fees, utilize procedures set forth in the Revenue Recapture Act, Minnesota Statutes Chapter 270A, as a claimant agency.

Section 2. That this ordinance shall take effect and be in force 30 days from and after its passage and publication.

STATEMENT OF PURPOSE:  The purpose of this ordinance is to authorize the Duluth public library to collect fees in accordance with the Revenue Recapture Act. The Act establishes a system of collecting debts owed to entities including local governmental units by applying any of a debtor's tax refunds to the amount of the debt. The debt must be $25 or more. Refunds which may be interrupted are individual income tax refunds, individual property tax credits or refunds, lottery winnings over $600 and political campaign refunds. Debtors will be notified at the time a claim is filed and at the time a refund is sent to the City. If a refund is intercepted, a $10 fee for each claim offset will be collected from the refund. Debtors will also be advised of the right to contest the validity of the claim.
