AN ORDINANCE AMENDING CHAPTER 50 OF THE DULUTH CITY CODE 1959, AS AMENDED, ZONING DISTRICT MAP NO. 11 AS CONTAINED IN THE APPENDIX TO CHAPTER 50, TO PROVIDE FOR THE RECLASSIFICATION FROM R-1-A SINGLE FAMILY RESIDENTIAL TO C-5 PLANNED COMMERCIAL, PROPERTY LOCATED ON THE NORTHEAST CORNER OF BOUNDARY AVENUE AND SKYLINE PARKWAY (THOMPSON-PATRONAS).

The city of Duluth does ordain:

Section 1. That Plate No.11 of the zoning district map as contained in the Appendix to Chapter 50 of the Duluth City Code, 1959, is amended to read as follows:

Section 2. That this ordinance shall take effect and be in force 30 days from and after its passage and publication.


STATEMENT OF PURPOSE: This amendment provides for a zoning change from R-1-a, Single Family Residential to C-5 Planned Commercial, for property located at 9211 West Skyline Parkway, the northeast corner of Boundary Avenue and Skyline Parkway. The intended use is for a restaurant/convenience store.

The requested rezoning is an undeveloped treed area and a residence owned by the petitioners is located adjacent on the east. The site measures approximately 320 feet in width along Skyline Parkway and extends approximately 300 feet in length along Boundary Avenue. The portion adjoining Skyline is below the roadway level and the site slopes up to the north.
