AN ORDINANCE AMENDING CHAPTER 50 OF THE DULUTH CITY CODE 1959, AS AMENDED, ZONING DISTRICT MAP NO. 29 AS CONTAINED IN THE APPENDIX TO CHAPTER 50, TO PROVIDE FOR THE RECLASSIFICATION OF THE UPPER SIDE OF THE NORTHEASTERLY CORNER OF SECOND AVENUE WEST AND THIRD STREET FROM R-4 APARTMENT RESIDENTIAL TO C-1 COMMERCIAL (SHAPIRO, ET AL.).

BY PRESIDENT GILBERT:

The city of Duluth does ordain:

Section 1. That Plate No.29 of the zoning district map as contained in the Appendix to Chapter 50 of the Duluth City Code, 1959, is amended to read as follows:

Section 2. That this ordinance shall take effect and be in force 30 days from and after its passage and publication.


STATEMENT OF PURPOSE: This amendment provides for rezoning from R-4, Apartment Residential, to C-1, Commercial, property located on the upper side of West Third Street between First and Second Avenues West. The property is described as Lots 25, 27, 29, 31, Duluth Proper First Division West Third Street. Property addresses are: 117, 123, 125, 125½ and 131 West Third Street.

The planning commission recommended denial, by a vote of 6-1-2, of this rezoning request following a public hearing at its regular meeting on June 28, 2000.

In making its recommendation the commission cited the following finding:  the zoning change is contrary to the historical planning and zoning efforts of the city and neighborhood.
