RESOLUTION GRANTING A TOWNHOUSE OR GROUP DWELLINGS SPECIAL USE PERMIT TO SHERMAN ASSOCIATES FOR PROPERTY LOCATED ON THE EAST SIDE OF WEST GATE BOULEVARD AT 67TH AVENUE WEST.

BY PRESIDENT GILBERT:

WHEREAS, George Sherman, president, Sherman Associates, has submitted to the city council a request for a special use permit for townhouse or group dwellings on property described as Lots 4, 5, 6 & 8 through 17, Block 6 and Lot 3, Block 12, West Gate Division, and located at 6700-6800 West Gate Boulevard, on the east side of West Gate Boulevard at 67th Avenue West; and said permit application was duly referred to the city planning commission for a study, report and public hearing, and the city planning commission has subsequently reported its approval to the city council; and

WHEREAS, the approval was made because of the city planning commission's findings that appropriate safeguards will exist to protect the comprehensive plan and to conserve and to protect property values in the neighborhood if conditions are observed.

NOW, THEREFORE, BE IT RESOLVED, that a special use permit is hereby granted to Sherman Associates to allow for the construction of seven four-unit townhouse style structures on 2.96 acres of land on the east side of West Gate Boulevard at 67th Avenue West, on the condition that the project be limited to, constructed and maintained in accordance with plans submitted by Sherman Associates entitled "West Gate Townhouses," sheets C2 and A2, dated 12/15/99, as identified as Public Document No. ________ and subject to the following terms and conditions:

That prior to the issuance of any construction permits, the following shall be approved in writing:
(a)  That the construction of the private roadway be approved by the city engineer and fire marshal for all weather access for all emergency vehicles and equipment;
(b)  That all utilities be provided easements as required by various agencies;
(c)  That a fire hydrant be installed as required by the fire marshal;
(d)  That an SCS Type II stormwater detention pond be constructed as approved in writing by the city engineer.


STATEMENT OF PURPOSE: The application for this special use permit was filed on December 28, 1999.  The planning commission extended the review period by 60 days at its meeting on January 26, 2000.  The statutory limit of 120 days expires on April 26, 2000.

This resolution grants a special use permit to Sherman Associates to allow for the construction of seven four-unit townhouse style structures (a total of 28 rental units) on 2.96 acres of land located on the east side of West Gate Boulevard at 67th Avenue West.

The planning commission considered this resolution at their regular meetings on January 26 and March 14.  On March 22, 2000, the planning commission recommended approval of this resolution by a vote of 8-1.  The staff has recommended approval of this special use permit with the conditions outlined in the body of this resolution.
