BY COUNCILOR NESS:00-0345R
RESOLUTION FORMING A TASK FORCE TO ADDRESS NONLEGISLATIVE OPTIONS AND SOLUTIONS FOR INDOOR CLEAN AIR IN DULUTH'S PUBLIC PLACES.
WHEREAS, the city council recognizes the rights of nonsmoking constituents to breathe clean air, employees' rights to work in a safe working environment, and the severe health risks associated with smoking and of second-hand smoke; and
WHEREAS, the city council also recognizes the rights of business owners to make decisions regarding their own business and the potential financial burden a smoking restriction would have on some establishments; and
WHEREAS, instead of imposing a universal or omnibus solution onto business owners, the council should promote case-by-case studies and solutions that fit each establishment;
NOW THEREFORE, BE IT RESOLVED:
(a) That the council oversee the formation of a task force to address non-legislative solutions to indoor air quality issues in public places in Duluth;
(b) That this committee be comprised of restaurant owners, food service and bar employees, smoke-free coalition members and other interested citizens;
(c) That the committee shall address potential options including, but not limited to:- A private, low-interest loan fund for air purification systems;(d) That this committee shall present to the council, at six-month intervals, a report on the progress made in the community to improve the indoor air quality of various establishments across the city; and
- Promotion of internal evaluation of smoking policies in each establishment with discussions between employees, customers, and owners;
- Seeking promotional opportunities for restaurants that decide to go completely smoke free;
- Evaluation of establishment's nonsmoking sections and promote action to address inadequacies; and
- Suggesting changes to update the Minnesota Clean Indoor Air Act;
(e) That should the council find in a year's time that insufficient progress has been made to address the aforementioned problems, the council may then reconsider an ordinance solution.
