RESOLUTION APPROVING THE TEMPORARY EXPANSION OF THE LICENSED PREMISES OF GRANDMA'S, INC. (GRANDMA'S SALOON AND GRILL), 522 LAKE AVENUE SOUTH AND GRANDMA'S ANGIES, INC. (LITTLE ANGIES), 11 EAST BUCHANAN STREET.

BY COUNCILOR EDWARDS:

BE IT RESOLVED, that the city council of the city of Duluth hereby approves the temporary expansion of the "designated serving area" of the following on sale intoxicating liquor licenses, subject to departmental approvals, with any specific restrictions:

Grandma's, Inc. (Grandma's Saloon & Grill), 522 Lake Avenue South, for June 17, 2000, with the serving and dancing ceasing at 12:30 a.m.

Grandma's Angie's, Inc. (Little Angie's), 11 East Buchanan Street, for June 17, 2000, with the serving ceasing at 12:30 a.m.



Alcohol, Gambling and Tobacco Commission Discussion of 5/9/00:

GRANDMA'S, INC. (GRANDMA'S SALOON & GRILL), 522 LAKE AVENUE SOUTH - APPLICATION FOR TEMPORARY EXPANSION OF THE LICENSED PREMISES OF THEIR ON SALE INTOXICATING LIQUOR LICENSE FOR JUNE 17, 2000.

Doug Dalager was present on behalf of the application. He reviewed that they will be erecting a 30 x 60 enclosed tent up in their parking lot where food and beverages will be served on Friday and Saturday night of the marathon. He continued to say that there will be off duty police officers working the event along with their own security, and that the music and the serving will cease by 12:30 am. To questioning from the board, Officer Christensen replied that he has reviewed their plans for the event and approves of the set up. There being no further discussion, Mr. McKinnon moved that THE APPLICATION OF GRANDMA'S, INC. (GRANDMA'S SALOON & GRILL), 522 LAKE AVENUE SOUTH, FOR TEMPORARY EXPANSION OF THE LICENSED PREMISES OF THEIR ON SALE INTOXICATING LIQUOR LICENSE FOR JUNE 17, 2000, BE APPROVED, AND THE SAME BE RECOMMENDED TO THE CITY COUNCIL FOR APPROVAL. Mr. Hendrickson seconded the motion, and it was unanimously approved.

GRANDMA'S ANGIE'S, INC, (LITTLE ANGIE'S), 11 E. BUCHANAN ST - APPLICATION FOR TEMPORARY EXPANSION OF THE LICENSED PREMISES OF THEIR ON SALE INTOXICATING LIQUOR LICENSE FOR JUNE 17, 2000.

Mark Swenson was present on behalf of the application, and stated that they were late with their application and that is why it is filed after the deadline. Mr. Swenson stated that they would like to put a bar out on their deck to serve during and after the marathon and have done this for the last five years. To questioning from the board, Mr. Swenson that they put 12 tables and chairs down on plaza area below the deck during the open drinking of the marathon, and once the marathon is over, they put the table and chairs up on the deck area which then becomes a confined area by the deck railing. The police cautioned Mr. Swenson that once the open drinking is stopped, they must move the tables up onto the deck and tighten up their security and not allow people off their deck with alcoholic beverages.

The board voiced concern that there is no sign on the deck that states that the public is allowed to use the table and chairs on the deck. Assistant City Attorney Smedberg reviewed that Grandma's obtained a concurrent use permit from the planning commission that stipulates the deck is considered a public sidewalk and although Little Angie's can set up table and chairs on the deck, the table and chairs must be open to the public to use without ordering food from Little Angie's. The board requested that a copy of the concurrent use permit be included in Little Angie's file so that the requirements for the use of the deck will be part of their license.

There being no further discussion, Mr. McKinnon moved that THE APPLICATION OF GRANDMA'S ANGIE'S, INC, (LITTLE ANGIE'S), 11 E. BUCHANAN ST, FOR TEMPORARY EXPANSION OF THE LICENSED PREMISES OF THEIR ON SALE INTOXICATING LIQUOR LICENSE FOR JUNE 17, 2000, BE APPROVED, AND THE SAME BE RECOMMENDED TO THE CITY COUNCIL FOR APPROVAL. Mr. Hendrickson seconded the motion, and it was unanimously approved.
