RESOLUTION APPROVING THE TEMPORARY EXPANSION OF THE LICENSED PREMISES OF VARIOUS ON SALE INTOXICATING LIQUOR LICENSES.

BY COUNCILOR EDWARDS:

BE IT RESOLVED, that the city council of the city of Duluth hereby approves the temporary expansion of the "designated serving area" of the following on sale intoxicating liquor licenses, subject to departmental approvals, with any specific restrictions:

PK & JS, Inc., (Twins Bar), 501 East 4th Street, for July 21, 2000, (rain date: July 22, 2000) with the music ceasing at 11:00 p.m. and the serving ceasing at midnight.

Scanlon River Inn, Inc, (Pioneer Bar), 323 West First Street, for July 14, 2000, with the music ceasing at 11:00 p.m. and the serving ceasing at 12:00 a.m. (rain date: July 15, 2000).

Lyric Block Development Corporation, (Porter's/Sneakers/Greenery), 207 West First Street, for August 11 and 12, 2000, with the music ceasing at 12:30 a.m. and the serving ceasing at 1:00 a.m.

Modern Hotel, Inc, (Roby's Bar/Tom's Junkyard), 2023 West Superior Street, for July 28, 2000, with the music ceasing at 11:00 pm and the serving ceasing at midnight (rain date: July 29, 2000)


Alcohol, Gambling and Tobacco Commission Discussion of 6/13/00:

MODERN HOTEL, INC, (ROBY'S BAR/TOM'S JUNKYARD), 2023 W. SUPERIOR ST - APPLICATION FOR TEMPORARY EXPANSION OF THE ON SALE INTOXICATING LIQUOR LICENSE FOR JULY 28, 2000. (RAIN DATE JULY 29TH)

Mark Glad was present on behalf of the application. Mr. Glad stated that they will be having a band and bar outside in their parking in July. He continued saying that they will be enclosing the open ends of the parking lot with snow fencing, and that they have hired two off duty police officers to work the event. To the board's questioning, Officer Christensen replied that the music would stop at 11:00 pm and the and outside serving would stop midnight. There being no further discussion, Mr. McKinnon moved THAT THE APPLICATION OF MODERN HOTEL, INC, (ROBY'S BAR/TOM'S JUNKYARD), 2023 W. SUPERIOR ST, FOR TEMPORARY EXPANSION OF THE ON SALE INTOXICATING LIQUOR LICENSE FOR JULY 28, 2000 (RAIN DATE JULY 29TH) BE APPROVED, AND THE SAME BE RECOMMENDED TO THE CITY COUNCIL FOR APPROVAL. Mr. Willman seconded the motion, and it was unanimously approved.

LYRIC BLOCK DEVELOPMENT CORP, (PORTER'S/SNEAKERS/ GREENERY), 207 WEST FIRST STREET - APPLICATION FOR TEMPORARY EXPANSION OF THE ON SALE INTOXICATING LIQUOR LICENSE FOR AUGUST 11 & 12, 2000.

Jamie Wilson was present on behalf of the application. Mr. Wilson stated that this is their annual Rally in the Alley event in conjunction with the Bluesfest at Bayfront. He reviewed that it is located in the parking lot in the alley, and that they obtain a permit to close down the alley to the public, but it can be opened easily for emergency vehicles. Officer Christensen stated that they allow the music and the serving until 12:30 am, and in the past they have had no problems with this event. There being no further discussion, Mr. Levey moved that THE APPLICATION OF LYRIC BLOCK DEVELOPMENT CORP, (PORTER'S/SNEAKERS/ GREENERY), 207 WEST FIRST STREET, FOR TEMPORARY EXPANSION OF THE ON SALE INTOXICATING LIQUOR LICENSE FOR AUGUST 11 & 12, 2000, BE APPROVED, AND THE SAME BE RECOMMENDED TO THE CITY COUNCIL FOR APPROVAL. Mr. Hendrickson seconded the motion, and it was unanimously approved.

SCANLON RIVER INN, INC, (PIONEER BAR), 323 W. 1ST ST. - APPLICATION FOR TEMPORARY EXPANSION OF THE ON SALE INTOXICATING LIQUOR LICENSE FOR JULY 14, 2000 (RAIN DATE JULY 15TH)

Jean Larson was present on behalf of the application. Ms. Larson stated that this application is in conjunction with Downtown Sidewalk Days street dance, and that they will be putting three bars outside on the street during the street dance. To the board's questioning, Office Christensen replied that there will be off duty police officers working the block, and that blockades and squad cars will be blocking off the ends of the block to prevent people leaving the area with drinks. He continued saying that the music will stop at 11:00 pm and the serving stops at midnight so that the area will be open by 1:00 am. There being no further discussion, Mr. McKinnon moved that THE APPLICATION OF SCANLON RIVER INN, INC, (PIONEER BAR), 323 W. 1ST ST., FOR TEMPORARY EXPANSION OF THE ON SALE INTOXICATING LIQUOR LICENSE FOR JULY 14, 2000 (RAIN DATE JULY 15TH), BE APPROVED, AND THE SAME BE RECOMMENDED TO THE CITY COUNCIL FOR APPROVAL. Mr. Levey seconded the motion, and it was unanimously approved.

PK & JS, INC, (TWINS BAR), 501 E. 4TH ST - APPLICATION FOR TEMPORARY EXPANSION OF THE ON SALE INTOXICATING LIQUOR LICENSE FOR JULY 21, 2000 (RAIN DATE JULY 22ND)

Pete Kilroy was present on behalf of the application. Mr. Kilroy stated that they are having a parking lot dance in July, and that they are applying to put their bar outside. To questioning from the board, Mr. Kilroy replied that they there is snow fencing around the open areas of the parking lot, and that the only entrance into the parking lot will be through the Twins Bar. He continued saying that there will be an off duty police officers working inside the bar and outside in the parking lot and checking ID's. To questioning from the board, Mr. Kilroy replied that the music will stop at 11:00 pm and the serving will stop at midnight. There being no further discussion, Mr. Willman moved THAT THE APPLICATION OF PK & JS, INC, (TWINS BAR), 501 E. 4TH ST, FOR TEMPORARY EXPANSION OF THE ON SALE INTOXICATING LIQUOR LICENSE FOR JULY 21, 2000 (RAIN DATE JULY 22ND), AND THE SAME BE RECOMMENDED TO THE CITY COUNCIL FOR APPROVAL. Mr. Hendrickson seconded the motion, and it was unanimously approved.
