AN ORDINANCE AUTHORIZING SALE OF CERTAIN PROPERTY IN WEST DULUTH TO MENARD, INC.

BY COUNCILOR STOVER:

The city of Duluth does ordain:

Section 1. That the proper city officials are hereby authorized to enter into an agreement, a copy of which is on file in the office of the city clerk as Public Document No. _____________________, to sell and convey all of city's interest in the following described property in St. Louis County, Minnesota, by quit claim deed, to Menard, Inc., for a price equal to $2.57 per square foot and to execute all documents necessary with regard to said conveyance:  Lots 1 through 4, inclusive, Block 171, WEST DULUTH Seventh Division, together with those portions of vacated public highways appurtenant to said lots, excepting, however, all minerals and mineral rights.

Section 2. This ordinance shall take effect 30 days from and after its passage and publication.


STATEMENT OF PURPOSE:  The purpose of this ordinance is to authorize the execution of an agreement to sell by quit claim deed city-owned property in West Duluth adjacent to Menard's West Duluth store to Menard to facilitate an expansion of that retail facility.

The property, consisting of 10,000 square feet more or less and shown on the map is located just east of where recently-constructed Elinor Street enters the northerly end of Menard's parking lot. The city had originally acquired the property in question as part of the purchase of old railroad right-of-way from the DWP. The city has no current use for the property except for a drainage easement which will either be retained or relocated at Menard expense but Menard wishes to acquire it to facilitate a possible expansion of their store.

The price was established by recent appraisal of property in the area by DEDA.
