RESOLUTION ISSUING AN ON
SALE INTOXICATING LIQUOR AND SUNDAY LIQUOR LICENSE TO LAKE SUPERIOR CENTER
AUTHORITY, 353 HARBOR DRIVE.
BE IT RESOLVED, that the
city council of the city of Duluth hereby issues an on sale intoxicating
liquor and Sunday liquor license to the following licensee, for the period
ending August 31, 2000, with an annual on sale intoxicating liquor license
fee of $2,650 and an annual Sunday liquor license fee of $125, subject
to departmental approvals:
Lake Superior Center
authority, 353 Harbor Drive, with David Lonsdale, executive director.
OF PURPOSE: In the Laws of Minnesota, 2000, Chapter 440, which
was just approved by the city council, the state legislature authorized
the city to issue any on sale intoxicating liquor license to the Lake Superior
Center authority for use to serve persons leasing space at the Lake Superior
Center for banquets, social affairs, conferences, meetings and conventions.
This resolution issues that license to the Lake Superior Center authority
for the standard license fee of $2,650 plus $125 for a Sunday license.
The authority has contracted with Bellisio's to manage the food and beverage
operation at the aquarium. The statute authorizing this license is similar
to those authorizing licenses at the DECC, Spirit Mountain and the airport.
Each of the licenses has an ordinance section specifying the terms and
conditions in each respective statute authorizing the license. It is anticipated
that a similar ordinance specifying terms and conditions of the license
will be presented to the alcohol, gambling and tobacco commission in the
next month or two for approval and submission to the city council. Because
such an ordinance is not a legal prerequisite to the issuance of this license
and because the Lake Superior Center will be opening very shortly, the
alcohol, gambling and tobacco commission has recommended issuing this license
now so the Lake Superior Center can begin immediately servicing banquets,
conventions and social events.
