RESOLUTION APPROVING THE TEMPORARY EXPANSION OF THE LICENSED PREMISES OF VARIOUS LICENSEES.

BY COUNCILOR EDWARDS:

BE IT RESOLVED, that the city council of the city of Duluth hereby approves the temporary expansion of the designated serving area of the following on sale intoxicating liquor licenses, subject to departmental approvals, with any specific restrictions:

Rustic Bar, Inc. (Rustic Bar), 401 North Central Avenue, for August 4, 2000, (rain date August 5, 2000), with the music ceasing and the serving ceasing at 12:30 a.m.

D&D Enterprises of Cloquet, Inc. (Mr. D's Bar & Grill), 5622 Grand Avenue, for August 4, 2000, (rain date August 5, 2000), with the music and the serving ceasing at 12:30 a.m.

Dwayne & Kimberly, Inc. (Kom On Inn), 332 North 57th Avenue West, for August 4, 2000, (rain date August 5, 2000), with the music and the serving ceasing at 12:30 a.m.

D&D Enterprises of Cloquet, Inc. (Mr. D's Bar & Grill), 5622 Grand Avenue, for September 9, 2000, with the music and the serving ceasing at 12:30 a.m.

Rustic Bar, Inc. (Rustic Bar), 401 North Central Avenue, for September 9, 2000, with the music ceasing and the serving ceasing at 12:30 a.m.

Alcohol, gambling and tobacco commission discussion of 7/11/00:

D & D ENTERPRISES OF CLOQUET, INC. (MR.D'S BAR & GRILL) 5622 GRAND AV.E - APPLICATION FOR TEMPORARY EXPANSION OF THE LICENSED PREMISES OF THEIR ON SALE INTOXICATING LIQUOR LICENSE FOR AUGUST 4, 2000, (RAIN DATE AUGUST 5, 2000) AND SEPTEMBER 9, 2000.

Mary Jurek was present on behalf of the application.  Ms. Jurek stated that the application for August 4th was in conjunction with annual Spirit Valley Days, and the September 9th date is for a motorcycle rally being sponsored by the United Way.  Ms. Jurek went on to say that the Ramsey street will be closed off to allow people to walk around with their drinks, and that they will start serving at 3:00 pm with the music and serving ceasing at 12:30 am.  To the board's questioning, Officer Christensen replied that they will be having off duty police officers working the event and checking ID's, reviewing that they are using wristbands to identify if the person is of legal drinking age.  He also stated that stopping the outside drinking and music at the same time worked well last year as it helped move the people from the area faster.  Ms. Jurek stated that for the September 9th event, Ramsey street will be closed off to allow parking for the motorcycles, and that they will be setting up a bar in the parking lot behind their building serving from 6:00 pm to 12:30 am.  Officer Christensen stated that he will be working with Mr. D's setting up security for the event.  There being no further discussion, Mr. McKinnon moved THAT THE APPLICATION OF D & D ENTERPRISES OF CLOQUET, INC. (MR.D'S BAR & GRILL) 5622 GRAND AVE,  FOR TEMPORARY EXPANSION OF THE LICENSED PREMISES OF THEIR ON SALE INTOXICATING LIQUOR LICENSE FOR AUGUST 4, 2000, (RAIN DATE AUGUST 5, 2000) AND SEPTEMBER 9, 2000, BE APPROVED, AND THE SAME BE RECOMMENDED TO THE CITY COUNCIL FOR APPROVAL.  Mr.  Willman seconded the motion, and it was unanimously approved.

DWAYNE & KIMBERLY, INC., (KOM ON INN), 332 N. 57TH AV. W. - APPLICATION FOR TEMPORARY EXPANSION OF THE LICENSED PREMISES OF THEIR ON SALE INTOXICATING LIQUOR LICENSE FOR AUGUST 4, 2000, (RAIN DATE AUGUST 5, 2000).

George Gothner, representing the Rustic Bar, and Kimberly Eider, representing the Kom on Inn, were present on behalf of the application.  Mr. Gothner and Ms. Eider stated that they were aware of the time frames for the music and serving and would have the same set up as last year.  Mr. Gothner stated he would also be involved on September 9th for the bike rally and was aware of the time frames for that event.  There being no further discussion, Mr. McKinnon moved that THE APPLICATIONS OF RUSTIC BAR INC., 401 N. CENTRAL AVE., FOR TEMPORARY EXPANSION OF THE LICENSED PREMISES OF THEIR ON SALE INTOXICATING LIQUOR LICENSE FOR AUGUST 4, 2000, (RAIN DATE AUGUST 5, 2000) AND SEPTEMBER 9, 2000, BE APPROVED, AND DWAYNE & KIMBERLY, INC., (KOM ON INN), 332 N. 57TH AV. W.,  FOR TEMPORARY EXPANSION OF THE LICENSED PREMISES OF THEIR ON SALE INTOXICATING LIQUOR LICENSE FOR AUGUST 4, 2000, (RAIN DATE AUGUST 5, 2000), BE APPROVED, AND  THE SAME BE RECOMMENDED TO THE CITY COUNCIL FOR APPROVAL.  Mr. Levey seconded the motion, and it was unanimously approved.

HOLIDAY INN OF TUCUMCARI, CANAL PARK INN, 250 CANAL PARK DRIVE - APPLICATION FOR A TEMPORARY EXPANSION OF THE LICENSED PREMISES OF THEIR ON SALE INTOXICATING LIQUOR LICENSE FOR AUGUST 11, 12 & 13TH, 2000.

Ryan Quisling was present on behalf of the application.  Mr. Quisling stated that this event is in conjunction with the Blues Fest, and that are setting up a tent in the parking of their hotel to have music and beverages.  He continued saying that there will be off duty police officers and also their own security working the tent area checking ID's at the entrance and inside the tent.  To questioning from the board, Officer Christensen replied that they would allow the music until midnight and the serving until closing.  He continued saying that he needs to review the security arrangements with Mr. Quisling and determine how many police officers will be needed.  Mr. Quisling stated that they will not be letting the people leave the tent with their drinks to enter the hotel or go out of the parking lot area.   There being no further discussion, Mr. Levey moved that THE APPLICATION OF HOLIDAY INN OF TUCUMCARI, CANAL PARK INN, 250 CANAL PARK DRIVE, FOR  TEMPORARY EXPANSION OF THE LICENSED PREMISES OF THEIR ON SALE INTOXICATING LIQUOR LICENSE FOR AUGUST 11, 12 & 13TH, 2000, BE APPROVED, AND THE SAME BE RECOMMENDED TO THE CITY COUNCIL FOR APPROVAL.  Mr. Willman seconded the motion, and it was unanimously approved.

LAC/TOM INVESTMENTS, LTD, (J & J LIMIT BAR), 1426 COMMONWEALTH AV., - APPLICATION FOR TEMPORARY EXPANSION OF THE LICENSED PREMISES OF THEIR ON SALE INTOXICATING LIQUOR LICENSE FOR JULY 28, 2000.

Carrie Mallory was present on behalf of the application.  Ms. Mallory stated that they are having a parking lot dance and will be fencing off an area of their parking lot for the serving and the dance.  She continued saying that the only entrances and exits will be through the bar, and there will be an off duty police officer working the dance.  To the board's inquiry, Officer Christensen replied that music would need to end at 11:00 pm and the serving would stop at midnight.   He continued saying that there is no problem with this application.  There being no further discussion, Mr. Levey moved that THE APPLICATION OF LAC/TOM INVESTMENTS, LTD, (J & J LIMIT BAR), 1426 COMMONWEALTH AV.,  FOR TEMPORARY EXPANSION OF THE LICENSED PREMISES OF THEIR ON SALE INTOXICATING LIQUOR LICENSE FOR JULY 28, 2000, BE APPROVED, AND THE SAME BE RECOMMENDED TO THE CITY COUNCIL FOR APPROVAL.  Mr. Hendrickson seconded the motion, and it was unanimously approved.
