RESOLUTION AUTHORIZING THE
EXECUTION OF AN AGREEMENT WITH LYLE BRIAN NELSON AND MARCIA A. NELSON TO
PETITION FOR A PERMANENT IMPROVEMENT OF SOUTH 32ND STREET.
RESOLVED, that the proper
city officers are hereby authorized to execute an agreement with Lyle Brian
Nelson and Marcia A. Nelson to petition for the permanent improvement of
South 32nd Street from Minnesota Avenue easterly to its platted terminus;
said agreement filed as Public Document No. __________________.
OF PURPOSE: This resolution authorizes the execution of
an agreement with L. Brian Nelson and his wife Marcia Nelson to petition
for the permanent improvement of South 32nd Street at any time the city
deems appropriate. The Nelsons own property on the Lake Superior side of
Park Point at the end of South 32nd Street. Though the lot is 58 feet wide,
only about 25 feet of lot fronts on improved street (the street dead ends
into the beach). The Nelsons want to sell the property to a buyer who wants
to raze the existing house on the existing parcel and build a larger house.
The lot is, under the zoning code, nonconforming in that it lacks the 50
feet of improved street frontage required to rebuild on the lot. This agreement,
which conforms to standards adopted by the special assessment board, will
allow a new house to be constructed on the lot because the city will have
the right to petition for the street improvement whenever it desires. In
reality, there is almost no possibility that the city would want to extend
the street across the sand dunes.
