RESOLUTION AUTHORIZING A FIVE-YEAR LEASE WITH THE U.S. ENVIRONMENTAL PROTECTION AGENCY FOR COVERING PART OF OUTLOT "D," EDGESHORE PARK DIVISION.

BY COUNCILOR FENA:

WHEREAS, the city owns a property parcel described as Outlot "D," Edgeshore Park Division; and

WHEREAS, the United States environmental protection agency located at 6201 Congdon Boulevard desires to continue utilizing said property for the collection of zoo plankton, natural water, and the holding of native species of frogs and other aquatic invertebrates.

NOW, THEREFORE, BE IT RESOLVED, that the proper city officers are hereby authorized and directed to execute a lease agreement substantially in the form attached for a period of five years with the United States environmental protection agency, covering a portion of Outlot "D," Edgeshore Park Division; said renewal to be in the form of that certain document on file in the office of the city clerk as Public Document No. _________________.


STATEMENT OF PURPOSE:  The city first entered into an agreement with the United States environmental protection agency in 1973 for the use of Outlot "D," Edgeshore Park Division.  This lease agreement has been updated to better define the permitted usage and maintenance expectations of the United States environmental protection agency laboratory located at 6201 Congdon Boulevard.  The pond area on the property is fenced and used by the United States environmental protection agency for the collection of zoo plankton, natural water, and for the temporary holding of native species of frogs and other aquatic invertebrates prior to being transferred into the United States environmental protection agency laboratory facility.  The ponds are also used to field test and calibrate experimentation equipment.

This resolution authorizes the execution of a new Lease and continues the United States environmental protection agency's utilization of this property for a five year period with option for review and future renewal for three additional five year periods.
