RESOLUTION REVERSING THE DECISION OF THE BUILDING APPEAL BOARD TO DENY A REQUEST TO LIFT THE CONDEMNATION FOR DEMOLITION ORDERS AND ALLOW A FURTHER EXTENSION OF TIME TO DEVELOP A PLAN FOR COMPLETE RENOVATION AT 222-224 WEST THIRD STREET AND 226 WEST THIRD STREET, DULUTH, MINNESOTA.

BY PRESIDENT GILBERT:

WHEREAS, Roy and Mary Anderson have appealed to the city council the decision of the building appeal board to deny their request to allow the lifting of the condemnation for demolition orders and allow further time to develop a complete plan for renovation of the structures at 222-224 West Third Street and 226 West Third Street; and

WHEREAS, the city council has considered this appeal and determined that the required findings for the granting of an appeal to allow the condemnation for demolition orders to be lifted can be made in this case.

NOW, THEREFORE, BE IT RESOLVED, by the city of Duluth that the building appeal board's decision of May 10, 2000, is hereby reversed by the city council and the appeal is approved.


STATEMENT OF PURPOSE:  This resolution reverses the decision of the building appeal board for an appeal of City Code, Chapter 10, Article II, Section 10-3 for property located at 222-224 West Third Street and 226 West Third Street. The applicant requested the condemnation for demolition orders be lifted and a further extension of time to develop a plan for complete renovation of the structure.
