NOW, THEREFORE, BE IT RESOLVED, that a special use permit is hereby granted to Duncan R. Puffer to allow for the construction and operation of a dental clinic of less than 10,000 square feet in the floor area on property located at 3617 West Arrowhead Road, on the following conditions:

That the property be developed based on the plans submitted by Blesener-Dahlberg-Prestidge Architects, entitled "Northern Oral & Maxillofacial Surgeons" dated 9-18-2000, as identified as Public Document No. ______________, subject to the following conditions being completed and approved in writing by the planning department prior to the issuance of any permits:
(a) That on site (free standing) signage be limited to not more than 32 square feet and non-illuminated;

(b) That storm drainage plans be approved in writing by the city engineer.

STATEMENT OF PURPOSE:  This resolution grants a special use permit to Dr. Duncan R. Puffer D.D.S. to allow for the construction and operation of a Dental Clinic of less than 10,000 square feet in floor area on property located at 3617 West Arrowhead Road.

The proposal is to construct a 54' by 78' (-8,000 sq. ft.), two story (three car tuck-under garage, walk out basement) with 24 off street parking spaces on a ten acre parcel in a suburban zone.

The application was submitted and reviewed in accordance with Sec. 50-35, DCC, enumerated:  (h) Clinic of less than 10,000 square feet in floor area or institutions.

The planning commission unanimously approved this resolution at its October 25, 2000,meeting.

The commission, in part, based its recommendation on the following findings:

This is an area zoned "suburban." Permitted uses range from agriculture and horticulture to low density residential. The minimum lot size is five acres. A number of churches have been established along this area of Arrowhead Road. Other land uses, such as a congregate care facility and the volleyball facility have been previously approved in this area.

1. Will the proposed special use result in a random pattern of development with little contiguity to existing or programmed development? No. This request is consistent with current zoning, previously approved uses of this parcel and consistent with the land use recommendations of northwest corner study (as approved by the planning commission- action by the city council is pending).

2. Will the requested use cause anticipated negative fiscal or environmental impacts upon the community? No. This use is considered to have a lessor impact than the previously approved use for the site.

3. Will conditions and safeguards protect the comprehensive plan and conserve and protect property and property values in the neighborhood? Yes. The compliance with the requirements of Section 50-32 of the City Code and this permit will achieve these criteria.

4. What appropriate conditions and safeguards, including performance bonds and a specified period of time for the permit, are necessary? None have been identified at this time.
