RESOLUTION REVERSING THE DECISION OF THE BUILDING APPEAL BOARD TO DENY AN APPEAL TO ALLOW A FURTHER EXTENSION OF TIME ON A GARAGE DEMOLITION ORDER TO THE END OF SUMMER 1999 TO COMPLETELY RENOVATE THE GARAGE, INCLUDING A NEW FOUNDATION, TO HOUSE VEHICLES, AT 23 EAST SEVENTH STREET, DULUTH, MINNESOTA.
WHEREAS, Edward Kale has appealed to the city council the decision of the building appeal board to deny his request to allow more time on a demolition order for garage only for him to completely renovate the garage, including a new foundation; and
WHEREAS, the city council has considered this appeal and Mr. Kale has presented appropriate evidence that he has the means, and will or will cause plans to be presented, permits obtained and required work performed to bring the garage into compliance with the codes and ordinances regulating buildings within the city of Duluth; and
WHEREAS, the city council has determined that the required findings for the granting of an appeal to set aside the demolition orders of December 15, 1998, and allow an extension of time for the renovation of the garage can be made in this case.
NOW, THEREFORE, BE IT RESOLVED,
by the city of Duluth that the building appeal board's decision of March
10, 1999, is hereby reversed by the city council and the appellant is granted
an extension until (council needs to establish a date certain for compliance
as the appellant requested until the end of summer 1999. If council determines
to overturn the decision of the building appeal board, staff recommends
separate dates to (a) submit plans; (b) obtain permits; and (c) complete
work) to bring the property into compliance, and the record in this
matter consists of the city file, the materials presented by the owner
and the city council proceedings.
