RESOLUTION AUTHORIZING A FIVE YEAR CONTRACT WITH WLSSD FOR WASTEWATER CAPACITY ALLOCATION AND SETTING COSTS.

        BE IT RESOLVED, that the proper city officials are authorized to execute and implement a contract, containing the terms and conditions of that contract on file with the city clerk as Public Document No. ________________ (corrections for matters such as spelling or typographical errors being authorized) between the city and Western Lake Superior Sanitary District, which allocates capacity for wastewater treatment.


STATEMENT OF PURPOSE:   The WLSSD provides treatment for sewage and wastewater created within the city.  The city is required to implement a capacity agreement which defines the limits of waste generated in Duluth that can be delivered to WLSSD's facilities.  This is a renewal of the agreement for the period 1995 to 2000.  The allocated capacities have not changed.  There is no charge unless capacities are exceeded.  The capacity allocation for biochemical oxygen demand (BOD) and total suspended solids (TSS) has increased from 16,800 lb/day to 20,000 lb/day and from 19,000 lb/day to 22,500 lb/day, respectively.  A surcharge fee for exceeding the allocated capacity is assessed only when the treatment plant incurs additional cost for treating the excess loading.  To date, the city has not been billed any surcharge fees.
