AN ORDINANCE AMENDING CHAPTER 50 OF THE DULUTH CITY CODE 1959, AS AMENDED, ZONING DISTRICT MAP NO. 12 AS CONTAINED IN THE APPENDIX TO CHAPTER 50, TO PROVIDE FOR THE RECLASSIFICATION OF THE WEST HALF OF BLOCK 40, HUNTER AND MARKELLS GRASSY POINT ADDITION TO DULUTH, FROM W-1 WATERFRONT TO R-1-C SINGLE FAMILY RESIDENTIAL.

BY COUNCILOR STENBERG:

        The city of Duluth does ordain:

        Section 1. That plat no. 12 of the zoning district map as contained in the appendix to Chapter 50 of the Duluth City Code, 1959, is amended to read as follows:

        Section 2. That this ordinance shall take effect and be in force 30 days from and after its passage and publication.


STATEMENT OF PURPOSE:  This ordinance provides for rezoning of the West Half of Block 40, Hunter and Markells Grassy Point Addition to Duluth, located Southeast of the corner of 72nd Avenue West and Milford Street, from "W-1" Waterfront to "R-1-c" Single Family Residential. The adjoining properties to the east are presently R-1-c and are either vacant or residential in use.

The City Planning Commission unanimously approved this rezoning at its regular meeting on March 13, 2001. Approval was based on the following findings:

1. This area, zoned W-1 since 1958, has remained undeveloped for any water related use for decades.

2. The W-1 zone around this cover of the river is no longer an appropriate land use classification. The land uses focusing on the immediate half mile of river front are residential.

3. The water frontage of this area is either owned by the City of Duluth or is private land subject to the Western Waterfront Trail Easement. Only a very limited area has adequate upland dimension for W-1 type development.
