ORDINANCE NO. __________

AN ORDINANCE AUTHORIZING SALE OF CERTAIN PROPERTY IN LESTER PARK TO JACK G. AND LEE K. HAGADORN.

BY COUNCILOR ECKENBERG:

The city of Duluth does ordain:

Section 1.     That the proper city officials are hereby authorized to sell and convey the following described property in St. Louis County, Minnesota, by quit claim deed, to Jack G. and Lee K. Hagadorn for the sum of $1,400 and to execute all documents necessary with regard to said conveyance:

The westerly 1/2 of Lot 3, Block 4, EDGEBROOK DIVISION OF DULUTH.

Section 2.     This ordinance shall take effect 30 days from and after its passage and publication.

STATEMENT OF PURPOSE:  The purpose of this ordinance is to authorize sale by quit claim deed of city-owned property in Lester Park to Jack and Lee Hagadorn for $1,400.

This property is located generally east of 54th Avenue East off Kingston Street and west of Seven Bridges Road. The parcel is 1/2 of a single lot, which is located in between parcels owned by the Hagadorn's and their neighbors, the LeDoux's. The Hagadorn's had originally requested that the city sell the entire lot to them in order to build a new home. The city deemed this lot to be excess of its needs and was willing to sell it, but inquiry of the adjacent property owners indicated that LeDoux's were also interested in purchasing the lot. Subsequently, however, the Hagadorn's and the LeDoux's agreed to each buy one half of the lot and each is willing to pay one half of the city's appraised price for the lot. This division of the lot will still provide the Hagadorn's sufficient square footage to build their new home. The lot was approved for sale by the city planning commission on August 14, 2001.
