RESOLUTION AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH DOUGLAS J. BLESENER AND MOLLY K. BLESENER TO EXTEND A WATERMAIN AND FOR A PERMANENT IMPROVEMENT OF TIOGA STREET NORTH OF COLORADO STREET.

BY COUNCILOR ECKENBERG:

        RESOLVED, that the proper city officials are hereby authorized to execute an agreement with Douglas J. Blesener and Molly K. Blesener to petition for the permanent improvement of Tioga Street from Colorado Street northerly and easterly to the terminus of the Woodridge Division of Duluth plat and for the construction of a watermain across the front of Lot 1, Block 1, Woodridge Division of Duluth; said agreement filed as Public Document No. ____________.



STATEMENT OF PURPOSE:  This resolution authorizes the execution of an agreement with Douglas J. Blesener and his wife Molly K. Blesener to petition for the permanent improvement of Tioga Street in the Woodridge Division plat at any time the city deems appropriate and to construct a watermain across the front of their lot. The Bleseners own Lot 1, Block 1, of Woodridge Division of Duluth, which is located at the westerly end of Colorado Street at its junction with platted, but unbuilt, Tioga Street.

The Bleseners wish to build a house on the lot. The lot touches improved Colorado Street but has insufficient street frontage. Under recent standards adopted by the special assessment board, the property can be developed if, and only if, the Bleseners enter into a recordable agreement with the city which obligates them to petition for the improvement of Tioga Street in front of Lot 1 whenever the city requests and to extend a watermain in the Tioga Street easement across the entire front of Lot 1. The Bleseners have examined and approved of the agreement.
