RESOLUTION AUTHORIZING PAYMENT OF $10,555.80 TO OHIO CASUALTY GROUP, AS SUBROGEE OF ROBERT OLSON, FOR SETTLEMENT OF ALL SUBROGATION CLAIMS ARISING FROM WATERMAIN BREAK ON JANUARY 30, 2000.

        BE IT RESOLVED, that the proper city officials are authorized to pay to Ohio Casualty Group, as subrogee of Robert Olson, the amount of $10,555.80 in full settlement of all claims for damage to their insured's property at 109 South 15th Avenue East resulting from a watermain break which occurred on January 30, 2000; payment to be made from the self insurance fund.



STATEMENT OF PURPOSE:  On January 30, 2000, a 24" city owned watermain burst in front of 109 South 15th Avenue East. Escaping water damaged the porch and foundation. Repair estimates were $13,600 and $11,091. Actual repair cost came to $10,555.80. The property owner, Robert Olson, collected this amount from his insurance company, Ohio Casualty Group, which now seeks recovery from the city. Liability is based upon the city's duty to operate its mains in a way that does not damage adjoining property. All the proper notices were given.
