RESOLUTION RATIFYING AND CONTINUING THE ACTING MAYOR'S LOCAL EMERGENCY DECLARATION OF APRIL 27, 2001.
BY PRESIDENT EDWARDS:

        WHEREAS, the city of Duluth has sustained losses of a major proportion brought on by an ice storm, rain, winds and flooding during March and April 2001; and

        WHEREAS, on April 27, 2001, Lynn Fena, acting Mayor of the city of Duluth, declared a local emergency pursuant to the provisions of Chapter 12, Minnesota Statutes;

        WHEREAS, Minnesota Statutes Section 12.29, subdivision 1, provides that no declaration of local emergency shall be continued for a period longer than three days without the consent of the local governing body of the political subdivision;

        NOW, THEREFORE, BE IT RESOLVED that the Duluth city council hereby approves of the declaration of local emergency made by acting Mayor Fena on April 27, 2001, and consents to the extension of this declaration until May 4, 2001.



STATEMENT OF PURPOSE:  This resolution approves of and authorizes the extension of the declaration of local emergency made by the acting Mayor after the recent ice storm which caused extensive damage to infrastructure and trees. Under the provisions of Minnesota Statutes, Chapter 12, which provides for emergency powers, appropriations and loans needed to meet local emergencies, the city council must approve of the Mayor's declaration of a local emergency if the declaration is to be valid for more than three days. This resolution accomplishes that end and extends the emergency date to May 4, 2001.
