AN ORDINANCE AMENDING CHAPTER
50 OF THE DULUTH CITY CODE 1959, AS AMENDED, ZONING DISTRICT MAP NUMBER
23 AS CONTAINED IN THE APPENDIX TO CHAPTER 50, TO PROVIDE FOR THE RECLASSIFICATION
FROM R-1-B, SINGLE FAMILY RESIDENTIAL, TO R-3, APARTMENT RESIDENTIAL, PROPERTY
LOCATED ON THE NORTH SIDE OF TRINITY ROAD WEST OF 2528 TRINITY ROAD (DULUTH
The city of Duluth does ordain:
Section 1. That Plate Number 23 of the zoning district
map as contained in the Appendix to Chapter 50 of the Duluth City Code,
1959, is amended to read as follows:
Section 2. That this ordinance shall take effect
and be in force 30 days from and after its passage and publication.
STATEMENT OF PURPOSE:
This zoning ordinance amendment provides for a zoning change, from R-1-b,
single family residential to R-3, apartment residential, for property located
adjacent to and west of Keystone Apartments at 2528 Trinity Road. The primary
purpose is to allow for the construction of garages for the existing apartments.
The area requested for rezoning is 137 feet wide and 473 feet in length.
The area is a partially treed hillside. The majority of the site has been
cleared. Based on the July 2001 aerial photo, it appears that no additional
clearing will be necessary for the garage project. The recommendation is
that the westerly 50 feet of Lot 1 remain R-1-b. This provides 115 feet
of buildable area for the desired expansion and 50 feet of "buffer" which
need not be further impacted by construction or the removal of vegetation.
This buffer provides some protection for the adjoining residential property.
The planning commission unanimously recommended approval of this ordinance
at its regular meeting on September 11, 2001.
