RESOLUTION APPROVING A RESOLUTION OF THE DULUTH AIRPORT AUTHORITY AUTHORIZING A RIGHT OF ENTRY AGREEMENT WITH THE MINNESOTA AIR NATIONAL GUARD.

        RESOLVED, that the Duluth City Council hereby approves, in accordance with Minnesota Laws 1969, Chapter 577, Section 11, subd. 2, a resolution of the Duluth Airport Authority (DAA) authorizing a right of entry agreement, on file in the office of the city clerk as Public Document No. ______________, between the DAA and the Minnesota air national guard.



STATEMENT OF PURPOSE:  The purpose of this resolution is to approve a DAA resolution for a right of entry agreement between the air national guard and the DAA, as required under Minnesota Law. The agreement will provide DAA temporary use of the south attached rooms (lean-to area) on Hangar 103. Hangar 103 is currently under a 12 year lease to the air national guard. The agreement will allow DAA to re-enter the lean-to for a one year period with an option for a second year extension and thus avoid the time consuming renegotiation of the entire lease. This in turn will allow DAA to lease the space to Cirrus Design which will provide Cirrus Design with critically needed temporary space to continue to increase aircraft production until the new aviation incubator facility is completed.
