RESOLUTION AUTHORIZING THE ACCEPTANCE OF THE DEDICATION OF A STREET EASEMENT IN A PARCEL ADJACENT TO NIAGARA STREET FROM THE COLLEGE OF ST. SCHOLASTICA.

        RESOLVED, that the proper city officers are hereby authorized to accept from the College of St. Scholastica, Inc., the dedication of a 33 foot by 50 foot street easement in the following described parcel of land located within the city of Duluth:
                In Section 15, Township 50 North, Range 14 West, that part of the southerly half of the northwest quarter commencing at the northeast corner, thence westerly along the north line 1298.88 feet to the point of beginning, thence south 0 degrees 3 minutes 43 seconds east 366.60 feet, thence west 266 feet, thence north 0 degrees 3 minutes 43 seconds west 29.35 feet, thence west 137.80 feet, thence north 0 degrees 3 minutes 43 seconds west 337.25 feet, thence east 403.80 feet to the point of beginning;
                said easement being more particularly described as follows, to-wit:  the northerly 33 feet of the easterly 50 feet of said parcel.



STATEMENT OF PURPOSE:  This resolution accepts a 33 foot by 50 foot street easement from the College of St. Scholastica. Niagara Street was improved in 1999 adjacent to the College of St. Scholastica. There was only a 33 foot platted easement for the roadway (St. Scholastica is located on unplatted property) so an easement had to be acquired. An easement was acquired for most of the construction area, but the construction area (roadway) ended up going 150 feet farther than initially anticipated. This easement is the last segment of easement necessary. In an agreement approved by the special assessment board, the college received a reduction in assessment of $1,735 for this easement and $5,250 for remaining extra easement. The agreement is set out in the letters from Mark Winson and Tom Brekke and the plat shows the easement.
