RESOLUTION AUTHORIZING THE PURCHASE OF A UTILITY EASEMENT FROM THE LAKE SUPERIOR & MISSISSIPPI RAILROAD FOR A CONSIDERATION OF $10.

BY COUNCILOR ECKENBERG:

        RESOLVED, that the proper city officers are authorized to execute an easement agreement substantially in the form of the agreement filed as Public Document No. ___, between the city of Duluth and Lake Superior & Mississippi Railroad, wherein the city is granted a utility easement across the railroad parking lot near Grand Avenue at 70th Avenue West for a consideration of $10.00; said money to be paid from Fund 0521, Agency 500, Object 5532. Said parcel and easement are more particularly described as follows:
                A utility easement across the following described parcel of land:
                A parcel of land located in Section 13, T49N, R15W, 4th P.M., St. Louis County, Minnesota, and being more particularly described as follows:
                        Beginning at a point lying N4948'51"E, 2811.20 feet, from the Southwest corner of said Section 13, thence S4654'56"E, 100.02 feet to a point, thence N4309'22"E, 340.48 feet to a point, thence S8904'18"W, 139.39 feet to a point, thence S4307'51"W, 243.62 feet to the Point of Beginning;
                Said easement more particularly described as:
                        An easement being a strip of land 40 feet in width, the Southeasterly line being described as follows:
                                Beginning at the Southwest corner of the above described parcel lying S4654'56"E, 27.00 feet to a point, thence N4317'35"E, 238.25 feet to a point, thence N5553'01"E, 41.15 feet to an intersection with the North property line of the above described parcel.



STATEMENT OF PURPOSE:  This resolution accepts a utility easement from the Lake Superior & Mississippi Railroad for the 16-inch supply gas line the city is building from town border station 1A in Wisconsin to the Lake Superior paper plant. The attached agreements and maps show where the easement is located. The easement runs across property the Lake Superior & Mississippi Railroad recently purchased from the Burlington Northern and Santa Fe Railroad for use as a parking lot for their tourist train operation.
