RESOLUTION AUTHORIZING THE PURCHASE OF A UTILITY EASEMENT FROM UNITED STATES STEEL LLC FOR A CONSIDERATION OF $5,000.

BY COUNCILOR ECKENBERG:

        RESOLVED that the proper city officers are authorized to execute an easement agreement substantially in the form of the agreement attached hereto and filed as Public Document No. _______, between the city of Duluth and United States Steel LLC, wherein the city is granted a utility easement across the United States Steel property in Gary New Duluth for a consideration of $5,000.00; said money to be paid from Fund 0521, Agency 500, Object 5532. Said parcel and easement are more particularly described as follows:
                A utility easement across the following described parcel of land:
                A parcel of land located in Section 3, T48N, R15W, 4th P.M., St. Louis County, Minnesota, and being more particularly described as follows:
                        Beginning at a point lying S3903'40"W, 1,056.27 feet from the Northeast corner of said Section 3, thence S6805'58"W, 679.50 feet to a point, thence S0153'54"E, 732.70 feet to a point, thence N6330'06"E, 625.30 feet to a point, thence N0154'02"W, 587.80 feet to a point, thence N4314'58"E, 113.00 feet to a point, thence N0501'39"W, 40.07 feet to the point of beginning.
                Said easement more particularly described as:
                        An easement being a strip of land 40 feet in width, the Southeasterly line being described as follows:
                                Said easement being a strip of land 40-foot in width, the Westerly line being described as follows: Beginning at the Point of Beginning of the above described parcel, lying S6805'58"W, 33.60 feet, from the Northeast corner of said parcel; thence S0924'01"E, 54.64 feet, intersecting and ending with the Southeast property line, thence S0930'52"E, 115.54 feet to a point, thence S2139'53"W, 74.77 feet to a point, thence S2832'15"W, 89.07 feet, intersecting and entering the East property line of the above described parcel, thence S2832'15"W, 80.30 feet to a point, thence S3710'19"W, 96.25 feet to a point, thence S4419'47"W, 202.32 feet to a point, thence S0012'34"W, 205.32 feet to an intersection with the South property line of the above described parcel. STATEMENT OF PURPOSE:  This resolution accepts a utility easement from United States Steel LLC for the 16-inch supply gas line the city is building from town border station 1A in Wisconsin to the Lake Superior paper plant. The agreements and maps show where the easement is located. The easement runs across US Steel property near where Dickson Street enters US Steel property in Gary New Duluth.
