RESOLUTION AUTHORIZING THE PURCHASE OF A UTILITY EASEMENT FROM WILLARD M. MUNGER, JR. AND SALLY L. MUNGER FOR A CONSIDERATION OF $7,000.

BY COUNCILOR ECKENBERG:

        RESOLVED that the proper city officers are authorized to execute an easement agreement substantially in the form of the agreement attached hereto and filed as Public Document No. , between the city of Duluth and Willard M. Munger, Jr. and Sally L. Munger, husband and wife, wherein the city is granted a utility easement across Lots 1-14, Block 35, Norton's Fairmount Park Division of Duluth, and Lot 14, Block 16, Hunter/Markell's Grassy Point Addition to Duluth, for a consideration of $7,000; said money to be paid from Fund 0521, Agency 500, Object 5532. Said parcel and easement are more particularly described as follows:

                        A parcel of land located in Lots 1-14, Block 35, Norton's Fairmount Park Division of Duluth, Section 13, T49N, R15W, 4th P.M., St. Louis County, Minnesota.
                Said easement being a strip of land approximately ten (10) feet in width and described as follows:
                        Beginning at the Northwest corner of Lot 1, Block 35, thence S4625'35"E, 124.37 feet to the Point of Beginning, thence S8037'44"E, 12.11 feet to a point, thence N4341'43"E, 136.0 feet to a point, thence 3729'54"E, 137.62 feet to a point, thence N3044'41"E, 53.62 feet to a point, thence N0129'12"W, 19.00 feet to a point, thence S3138'14"W, 78.24 feet to a point, thence S3722'43"W, 127.27 feet to a point, thence S4341'43"W, 142.29 feet to the Point of Beginning.
                INCLUDING an easement across the following described property:
                        A parcel of land located in Lot 14, Block 16, Hunter/Markell's Grassy Point Addition to Duluth, Section 13, T49N, R15W, 4th P.M., St. Louis county, Minnesota.
                Said easement being a strip of land approximately ten (10) feet in width and described as follows:
                        Beginning at the Northwest corner of Lot 14, Block 16, thence S4617'50"E, 74.05 feet to the Point of Beginning, thence S4622'33"E, 10.00 feet to a point, thence N4337'27"E, 24.78 feet to a point, thence N4617'50"W, 10.00 feet to a point, thence S4337'27"W, 24.80 feet to the Point of Beginning.



STATEMENT OF PURPOSE:  This resolution accepts a utility easement from Willard and Sally Munger for the 16-inch supply gas line the city is building from town border station 1A in Wisconsin to the Lake Superior paper plant. The attached agreements and maps show where the easement is located. The easement runs across Lots 1-14, Block 35, Norton's Fairmount Park Addition to Duluth, and Lot 14, Block 16, Hunter/Markell's Grassy Point Addition to Duluth.
