RESOLUTION AMENDING RESOLUTION 01-0525 ISSUING AN ON SALE NONINTOXICATING MALT LIQUOR LICENSE AND ON SALE WINE LICENSE TO DARREL FREDRICKSON (HORSESHOE BILLIARDS), 2415 WEST SUPERIOR STREET.

BY PRESIDENT EDWARDS:

        BE IT RESOLVED, that Resolution 01-0525 issuing the following on sale non intoxicating malt liquor license for the period ending April 30, 2002, and approving the issuance of the following on sale wine license for the period ending August 31, 2001, is hereby amended to change the effective dates of the on sale wine license to the period beginning September 1, 2001, and ending August 31, 2002:  Darrel Fredrickson (Horseshoe Billiards), 2415 West Superior Street.



STATEMENT OF PURPOSE: The alcohol, gambling and tobacco commission recommended approval to the city council Mr. Fredrickson's wine and beer application at their July 10, 2001, meeting. The council passed Resolution 01-0525 at their July 23, 2001, council meeting approving Mr. Fredrickson's wine and beer license. Mr. Fredrickson had anticipated being open by August 1, 2001, and had requested his wine license to be effective for the license year ending August 31, 2001. There have been delays in the remodeling of his building so he is unable open in August for business. Mr. Fredrickson has requested that his wine application be changed to be effective for the license year starting September 1, 2001, and ending August 31, 2002.

Alcohol, gambling and tobacco commission discussion of 7/10/2001: Darrel Fredrickson was present on behalf of the application. Mr. Fredrickson stated he is in the process of remodeling a building to be used as a billiard parlor along with an arcade of games. He continued by saying that along with his 20 pool tables and 30 video games, he will be installing a kitchen and will be having a full sit down menu with tables so he will be able to serve beer and wine. To questioning from the commission, Mr. Fredrickson stated he his trying to create a place where kids can come to and play pool and video games which will help keep them off the streets in that area of town. The board voiced concern of serving alcohol with minors in the facility and Mr. Fredrickson replied that he is aware of the rules and regulations of selling alcohol and will be very diligent in their efforts of preventing selling to minors. He continued by saying that with the pool tournaments he has, there will be teams coming from other cities including Canada and would like to be able to serve beer to the customers. Mr. Fredrickson stated his kitchen would not be ready to open until September but would be able to serve a limited menu of hot dogs, pizza and chips, and questioned if he would be able to serve beer and wine when he opened August 1, 2001. Assistant City Attorney Smedberg replied that it would be no problem to serve the beer as there are no food conditions connected with that license. He went on to say that he could serve wine as long as he has a limited menu available to the public for a short time until the kitchen is ready for regular meals. Officer Christensen stated he would be out to check on the facility and go over the rules of selling alcohol when he delivers the license to Mr. Fredrickson. There being no further discussion, Mr. McKinnon moved that THE APPLICATION OF DARREL FREDRICKSON (HORSESHOE BILLIARDS), 2415 WEST SUPERIOR STREET, FOR AN ON SALE WINE LICENSE AND ON SALE NONINTOXICATING MALT LIQUOR LICENSE FOR THE PERIOD ENDING AUGUST 31, 2001, AND APRIL 30, 2002, BE APPROVED, AND THE SAME BE RECOMMENDED TO THE CITY COUNCIL FOR APPROVAL. Mr. Nyquist seconded the motion, and it was unanimously approved.
