RESOLUTION AUTHORIZING THE EXECUTION OF A STREET DISCLAIMER AGREEMENT WITH MICHAEL J. HORVAT AND KIRSTEN L. HORVAT FOR A PERMANENT IMPROVEMENT OF LOCHAIRE AVENUE.

        RESOLVED, that the proper city officials are hereby authorized to execute an agreement with Michael J. Horvat and Kirsten L. Horvat to petition for the permanent improvement of Lochaire Avenue along its frontage with Outlot A, Greysolon Farms, First Division of Duluth; said agreement filed as Public Document No. ________.



STATEMENT OF PURPOSE:  This resolution authorizes the execution of an agreement with Michael J. Horvat and his wife Kirsten L. Horvat to petition for the permanent improvement of Lochaire Avenue along its frontage with Outlot A, Greysolon Farms, 1st Division of Duluth at any time the city deems appropriate. The Horvats own the westerly 1/2 of Outlot A, Greysolon Farms, First Division of Duluth.  The Horvats wish to build a house on the lot. The lot has insufficient street frontage under our zoning code to build. Under recent standards adopted by the special assessment board, the property can be developed if, and only if, the Horvats enter into a recordable agreement with the city which obligates them to petition for the improvement of Lochaire Avenue along Outlot A whenever the city requests. The Horvats have examined and approved of the agreement.
