RESOLUTION APPROVING THE MILLER CREEK DIAGNOSTIC STUDY AND IMPLEMENTATION PLAN, CLEAN WATER PARTNERSHIP PHASE 1 REPORT.

BY COUNCILOR STENBERG:

        WHEREAS, the city of Duluth did, on June 10, 1996, approve Resolution 96-0525 and did enter into a grant agreement (City Contract No. 17704) and did on August 9, 1999, unanimously adopted Resolution 99-0613 extending the agreement with the Minnesota pollution control agency for a clean water partnership grant to conduct the Miller Creek watershed preservation and restoration project; and

        WHEREAS, the Miller Creek diagnostic study and implementation plan, clean water partnership phase 1 report has been submitted to the city council for review and approval and said study and implementation plan was referred to the city planning commission for study and comment, and the city planning commission has subsequently reported its approval to the city council; and

        WHEREAS, the approval was made because of the city planning commission's findings that the project is in the best interests of the community and the environment of Miller Creek.

        NOW, THEREFORE, BE IT RESOLVED, that the city council of the city of Duluth approves the Miller Creek diagnostic study and implementation plan, clean water partnership phase 1 report.



STATEMENT OF PURPOSE:  This resolution approves the Miller Creek diagnostic study and implementation plan, clean water partnership phase 1 report. This is the culmination of five years of work under an agreement with the Minnesota pollution control agency and the city of Duluth. By approving this document, the project will qualify for additional funding through the Minnesota pollution control agency.   The executive summary is on page three and the history of this project is discussed on page five of the report. The implementation plan is outlined on pages 30-34. The planning commission approved this resolution at its September 11, 2001, meeting.
