RESOLUTION VACATING A PORTION OF STROLL AVENUE SOUTH OF PALM STREET AND A PORTION OF OVERLAND AVENUE BETWEEN BLACKMAN AND HARDING AVENUES (CURRY-BRANDAW).

BY COUNCILOR STENBERG:

        WHEREAS, a sufficient petition was filed with the city clerk requesting the vacation of a portion of Stroll Avenue south of Palm Street and a portion of Overland Avenue between Blackman and Harding avenues legally described as: Stroll Avenue adjoining Lot 8, Block 3, and Lots 5,6,9,10 and 11, Block 4, Car Line Gardens and Lots 9 through 16, Asiala's Garden Tracts; and Overland Avenue adjoining Lots 8,9,10 and 11, Block 3, and Lots 3,4, and 5, Block 4, Car Line Gardens and Lot 16, Asiala's Garden Tracts; and

        WHEREAS, pursuant to Section 100 of the City Charter and Article IV of Chapter 45 of the Duluth City Code, 1959, as amended, such petition was duly referred to the city planning commission, and such commission gave due notice of public hearing and did consider same in public hearing; and

        WHEREAS, the city planning commission approved, unanimously, the vacation petition at its November 13, 2001, meeting.

        NOW, THEREFORE, BE IT RESOLVED, that the city council of the city of Duluth approve the vacation of a portion of Stroll Avenue and a portion of Overland Avenue described above, and as more particularly described on Public Document No._______.

        BE IT FURTHER RESOLVED, that the city clerk is hereby directed to record, with the register of deeds and/or the registrar of titles of St. Louis County, Minnesota, a certified copy of this resolution together with a plat showing the portion of the streets to be vacated.



STATEMENT OF PURPOSE:  This resolution vacates a portion of Stroll Avenue and a portion of Overland Avenue, located south of Palm Street between Blackman and Harding Avenues.  The purpose of the vacation is to facilitate the development of a 115-unit retirement residence. This is a companion action to the rezoning adopted by council Ordinance No. 9512 on November 13, 2001.  The city planning commission considered this request on October 9, 2001, and unanimously approved this vacation at its meeting on November 13, 2001.
