AN ORDINANCE AMENDING SECTION 35 OF THE DULUTH CITY CHARTER TO INCREASE THE NUMBER OF MEMBERS OF THE CIVIL SERVICE BOARD TO FIVE.

BY COUNCILOR STEWART:

The city of Duluth does ordain:

Section 1. That Section 35 of the 1912 Charter of the city of Duluth, as amended, is hereby amended to read as follows:

Sec. 35. Civil service board--established; membership; term of office; vacancies.

There is hereby established a civil service board, which shall consist of three (3) five members, who shall be appointed by the council, and shall serve without compensation, and whose term of office shall be for six (6) years, except as herein next provided. The council first elected under this Charter, as soon as practicable after its election, shall appoint one (1) member of said board to serve for two (2) years, one (1) member to serve for four (4) years, and one (1) member to serve for six (6) years. Without delay, after the size of the membership of the board is increased to a total of five members, the council shall appoint two new members, one member to serve an initial term of four years and one member to serve an initial term of six years. Any vacancies in the board shall be filled by the council for the unexpired term.

Section 2. That this ordinance shall take effect and be in force 90 days from and after its passage and publication.


STATEMENT OF PURPOSE:  This proposed increases the number of members of the civil service board from three to five. With only three members, if one or more is absent, it is difficult to conduct business. The ordinance requires the affirmative vote of all members of the council.
