AN
ORDINANCE AMENDING CHAPTER 50 OF THE DULUTH CITY CODE 1959, AS AMENDED,
ZONING DISTRICT MAP NO. 28, AS CONTAINED IN THE APPENDIX TO
CHAPTER 50, TO PROVIDE FOR THE RECLASSIFICATION FROM R-1-B, SINGLE
FAMILY RESIDENTIAL, TO C-4, BUSINESS CENTER COMMERCIAL DISTRICT,
PROPERTY LOCATED AT 24 WILLOW STREET (ERLEMEIER/BAKER/LARSON).

The
city of Duluth does ordain:
Section 1.
That Plate
No. 28 of the zoning district map, as contained in the Appendix to Chapter
50 of the Duluth City Code, 1959, is amended to read as follows:

Section 2.
That this ordinance shall take effect and be in force 30 days from and
after its passage and publication.
STATEMENT
OF PURPOSE: This zoning ordinance amendment provides a zoning
change, from R-1-b, One Family Residential, to C-4, Business Center Commercial
District, the former St. Louis County First District toolhouse property
located at 24 East Willow Street in Duluth Heights.
The
Duluth city planning commission unanimously recommended denial of this
zoning change following a public hearing held March 9, 2004.
In
recommending denial of the zoning change, the commission made the following
findings of fact in support of the denial:
1.
There is no
private right to the use of this property; a limited use was granted to
St. Louis County for the public convenience;
2.
The C-4, Business Center Commercial District, by its title as well as
the historical application by the city, is intended for the business center
of the city of Duluth, not for random application throughout the city;
3.
There is no relationship to historic or current land use planning efforts
in this neighborhood;
4.
This is a spot zone request (see definition in the staff report).
