AN ORDINANCE AMENDING
CHAPTER 50 OF THE DULUTH CITY CODE 1959, AS AMENDED, ZONING DISTRICT
MAP NO. 17, AS CONTAINED IN THE APPENDIX TO CHAPTER 50, TO
PROVIDE FOR THE RECLASSIFICATION FROM M-1, MANUFACTURING, TO C-2,
HIGHWAY COMMERCIAL DISTRICT, PROPERTIES LOCATED ALONG THE LOWER
SIDE OF GRAND AVENUE BETWEEN 41ST AND 42ND AVENUES WEST (ESLER,
ET AL.). |

The
city of Duluth does ordain:
Section 1.
That Plate
No. 17 of the zoning district map as contained in the Appendix to Chapter
50 of the Duluth City Code, 1959, is amended to read as follows:

Section 2.
That this ordinance shall take effect and be in force 30 days from and
after its passage and publication.
STATEMENT
OF PURPOSE: This zoning ordinance amendment provides a zoning
change, from M-1, Manufacturing, to C-2, Highway Commercial District,
properties located along the lower side of Grand Avenue between 41st and
42nd Avenues West.
The
Duluth city planning commission unanimously recommended approval of this
zoning change following a public hearing held March 9, 2004.
In
recommending approval of the zoning change, the commission made the following
findings of fact in support of the change:
1.
This
zoning change provides an appropriate transition between residential and
light manufacturing.
2.
This
is an expansion of an existing commercial zone.
3.
This
request is consistent with the(Comprehensive) Draft Schematic Plan for
District #2. It is not inconsistent with the 1987 West Duluth Plan.
4.
This request will make the three existing residential uses "conforming."
