BY PRESIDENT STAUBER:
The city of Duluth does ordain:
Section 1.That the proper city officials are hereby authorized to enter into a development agreement substantially in the form of that on file in the office of the city clerk as Public Document No. _______ with St. Louis County for the sale of the Ten Commandments monument and the property upon which it is located.
Section 2. That pursuant to said agreement, the proper city officials are hereby authorized to convey the property in St. Louis County, Minnesota, described on Exhibit A (Public Document No. _________) to St. Louis County, by quit claim deed, and the monument located thereon, for nominal consideration.
Section 3.This ordinance shall take effect 30 days from and after its passage and publication.
STATEMENT OF PURPOSE: The purpose of this ordinance is to authorize the conveyance of the Ten Commandments monument and the property upon which it is located to St. Louis County for nominal consideration in consideration of their willingness to use their best efforts to keep the monument in place and protect the city from any costs or liability for not immediately removing it.
Under the agreement, the city would sell the monument and the land upon which it is located to the county. They would agree to maintain the monument and the property in perpetuity and to use their best efforts to resist any legal actions to compel its removal.
