AN ORDINANCE AMENDING CHAPTER 50 OF THE DULUTH CITY CODE 1959, AS AMENDED, ZONING DISTRICT MAP NOS. 36 AND 37 AS CONTAINED IN THE APPENDIX TO CHAPTER 50, TO PROVIDE FOR THE RECLASSIFICATION FROM S, SUBURBAN, TO R-1-A, SINGLE FAMILY RESIDENTIAL, PROPERTY LOCATED AT THE WEST END OF MIDDLE ROAD (J. HOVLAND).

BY COUNCILOR GILBERT:

The city of Duluth does ordain:

Section 1. That Plate Nos. 36 and 37 of the zoning district map as contained in the Appendix to Chapter 50 of the Duluth City Code 1959, is amended to read as follows:

Section 2. That this ordinance shall take effect and be in force 30 days from and after its passage and publication.


STATEMENT OF PURPOSE:  This ordinance amendment provides a zoning change, from S, Suburban, to R-1-a, One Family Residential, property located at the west end of Middle Road, west of Howard Gnesen Road, north of MacFarlane Road, and east of Northridge Estates in the Kenwood neighborhood.

This rezoning request involves 22 acres of 40 acres being subdivided out of 60 plus acres of unplatted land and a small portion of Outlot C in the plat of Northridge Estates. The balance of the land will remain as S, Suburban.

This rezoning is to facilitate the 24 residential lot development of Cedar Ridge Estates, an additional phase of North Ridge Estates. The applicant states that "this rezoning will be in the public interest because it will add needed housing."

The Duluth city planning commission unanimously approved this zoning change following a public hearing held April 28, 2004.

In approving the zoning change the commission made the following findings of fact in support of the change:
(a) This is an expansion of an existing R-1-a zoning district.
(b) This action is consistent with neighborhood plans and the adjoining plat.
