RESOLUTION APPROVING SETTLEMENT OF CLAIM OF STATE FARM INSURANCE, AS SUBROGEE OF ADAM AND DAVID TEMPLIN, IN THE AMOUNT OF $10,649.39.

BY COUNCILOR STOVER:

RESOLVED, that the proper city officials are authorized to pay to State Farm Insurance, as subrogee of Adam and David Templin, the amount of $10,649.39 in full and final settlement of all claims for damage to their insureds' vehicle when struck by snow plow/sanding truck near Woodland Avenue and Elizabeth Street on January 26, 2004; payment to be made from the Self-Insurance Fund 0610.


STATEMENT OF PURPOSE:  On January 26, 2004, an accident occurred near the intersection of Woodland Avenue and Elizabeth Street in the city of Duluth between Adam Templin and Matthew Dunaisky, an employee of the city of Duluth. At that time, Dunaisky was operating a snow plow/sanding truck when he pulled out from a stop sign, lost traction to the rear wheels and the vehicle spun. A collision occurred with the vehicle driven by Adam Templin, and owned by David Templin, resulting in damage to the Templin vehicle.

The city of Duluth investigated the claim and verified the damages and expenses. An agreement has been reached to settle the claim for $10,649.39. The city attorney's office recommends this settlement.
