REPLACEMENT

RESOLUTION AUTHORIZING THE ACQUISITION OF A PARCEL OF TAX FORFEIT PROPERTY LOCATED IN MORRIS PARK DIVISION OF LAKESIDE, FOR A PUBLIC USE, FROM THE STATE OF MINNESOTA THROUGH ST. LOUIS COUNTY AS A FREE CONVEYANCE.

BY COUNCILOR STOVER:

RESOLVED, that the proper city officers are hereby authorized to acquire from the state of Minnesota, through St. Louis County, the tax forfeit real property described as follows:
Lots 104 through 112, except the westerly 20 feet of lot 112, Morris Park Division of Lakeside.

The above-described property will be used only for the public use of a site for a sanitary sewer overflow storage facility operated by the city of Duluth as part of its sanitary sewer system. The proper city officials are authorized to request a free conveyance of the property and to do acts required to secure a free conveyance.


STATEMENT OF PURPOSE:  The purpose of this resolution is to authorize the acquisition of a parcel of tax forfeit property from the state through St. Louis County to be used for the planned sanitary sewer overflow storage facility in Lakeside/Lester Park.

As councilors are aware, the city is under orders from the MPCA and the EPA to eliminate the discharge of sanitary sewage into Lake Superior occurring during periods of overload in the system caused by heavy precipitation and its infiltration into the sanitary sewer system. In order to comply with these requirements in the Lakeside/Lester Park area, the city has proposed the construction of a major holding facility which would allow the excess sewer flow to be stored and then fed into the system as capacity allows.

The nine lots in question, located at 52nd Avenue East and Dodge Street, are presently forfeited to the state for non-payment of real estate taxes. The city can acquire these lots for public use by way of a free conveyance. They would then be incorporated into the new facility which will include the storage facility and an integrated new lift station.
