The city of Duluth does ordain:
Section 1. That Plate No. 12 of the zoning district map as contained in the Appendix to Chapter 50 of the Duluth City Code, 1959, as amended, is amended to read as follows:
Section 2. That this ordinance shall take effect and be in force 30 days from and after its passage and publication.
STATEMENT OF PURPOSE: This zoning ordinance amendment provides a zoning change from R-2, Two-Family Residential District, to R-3, Apartment Residential District, Block 8 of Hunters Grassy Point Third Division. This block is located at the southeast corner of 69th Avenue West and Sherburne Street, approximately 125 feet northwest of Grand Avenue in the West Duluth neighborhood.
The purpose of this rezoning is to make property available for the development of apartments. The applicant states that "[they] believe this rezoning will be in the public interest because as the piece sits, it is too small for any development. If it can be rezoned, [they] would combine it with [their] adjoining R-3 property (Block 7) for development of apartments. [They] feel the public needs to have additional quality living facilities in the city of Duluth."
The planning commission held a public hearing July 13, 2004. The petition was denied when a motion to recommend approval of the zoning change failed by a vote of 3 to 8. The commissioners based their recommendation for denial on the following finding: the current zoning provides an important buffer and transition zone between the R-2 areas and the R-3 area.
A companion request accompanied this rezoning petition - a petition to vacate the alley between Blocks 7 and 8 of Grassy Point Addition. (Reference File No. 04069)
The alley is 125 feet northwest of Grand Avenue and it connects 69th Avenue West and Sherburne Street.
