BY COUNCILOR GILBERT: The city of Duluth does ordain:
STATEMENT OF PURPOSE: This ordinance amendment provides a zoning change, from R-1-b, One Family Residential, to R-3, Apartment Residential, property located south of Piedmont Avenue and northwest of Nanticoke Street, 400-650 feet west of the intersection of Piedmont Avenue and Nanticoke Street. The purpose of this rezoning is to legitimize an existing building at 2839 Piedmont, which has three living units, and make the properties available for apartment development (no current plans). The planning commission recommended, by a unanimous vote, denial of this zoning change following a public hearing held July 13, 2004. The commissioners based their recommendation for denial on the following finding: this is an inappropriate intrusion of high density multi family zoning in an established single family neighborhood.
