The city of Duluth does ordain:
Section 1. That Plate No. 37 of the zoning district maps as contained in the Appendix to Chapter 50 of the Duluth City Code, 1959, is amended to read as follows:

Section 2. That this ordinance shall take effect and be in force 30 days from and after its passage and publication.
STATEMENT OF PURPOSE: This zoning ordinance amendment provides a zoning change, from R-1-c, One Family Residential to C-1, Commercial District, 14 lots on the southwest corner of Arrowhead Road and Kenwood Avenue in the Kenwood neighborhood. This rezoning is to facilitate the development of a bank with drive-through facilities. The applicant states that “this rezoning will be in the public interest because it would compliment the other 3 corners which are commercially used with a use that has limited impact to the neighborhood and traffic flow. Also, it would greatly enhance the appearance of the corner.”
The Duluth City Planning Commission voted 6-3-1 to recommend denial of this zoning change following a public hearing held August 25, 2004. (see companion resolution to deny)
The planning staff had recommended approving the zoning change based on the following findings in support of the change:
1. This rezoning is an expansion of existing commercial zoning on the north and west.
2. The rezoning recognizes the existing uses.
3. The Draft District 10 Plan, City of Duluth Comprehensive Plan, December 13, 2001, page 1, states in part:
“Economic Goal 1: Improve existing commercial centers and consider
the potential for new commercial centers in the District.
#3. Commercial centers should be concentrated in nodes, not strips, along arterials.
#8. Expand neighborhood commercial uses along the west side of Kenwood Avenue between Toledo Street and Arrowhead Road.”
The District 10 Schematic Plan shows this area recommended as part if a “Neighborhood Commercial”
