RESOLUTION APPROVING THE TRANSFER OF THE OFF SALE 3.2 PERCENT MALT LIQUOR LICENSES OF SPEEDWAY/SUPERAMERICA, LLC (SUPER AMERICA #4360), 3301 WEST ARROWHEAD ROAD, TO HOLIDAY STATIONSTORES, INC. (HOLIDAY STATION STORE #354), SAME ADDRESS, AND SPEEDWAY/SUPERAMERICA, LLC (SUPER AMERICA #4095), 2432 LONDON ROAD, TO HOLIDAY STATIONSTORES, INC. (HOLIDAY STATION STORE #353), SAME ADDRESS.

BY COUNCILOR STEWART:

     BE IT RESOLVED, that the city council of the city of Duluth hereby approves the transfer of the following off sale 3.2 percent malt liquor licenses for the period ending April 30, 2005, subject to departmental approvals:

          Holiday Stationstores, Inc, (Holiday Station Store #354), 3301 West Arrowhead Road, transferred from Speedway/SuperAmerica, LLC (Super America #4360) same address.

          Holiday Stationstores, Inc. (Holiday Station Store #353), 2432 London Road, transferred from Speedway/SuperAmerica, LLC (Super America #4095), same address.


Alcohol, gambling and tobacco commission discussion of 8/4/2004: Kevin Gulbranson was present on behalf of the application. Mr. Gulbranson explained that they are transferring ownership of these two gas stations on September 9 and would like to continue selling 3.2 percent beer and plan on applying to keep the 2:00 a.m. To the commission’s questioning, Mr. Gulbranson replied that they currently sell beer at the other six stores in the Duluth area, and that they plan on retaining the current employees in the these two stores. There being no further discussion, Mr. Johnson moved THAT THE APPLICATIONS OF HOLIDAY STATIONSTORES, INC. (HOLIDAY STATIONSTORE #354), 3301 WEST ARROWHEAD ROAD, AND 2432 LONDON ROAD, FOR TRANSFER OF THE OFF SALE 3.2 PERCENT MALT LIQUOR LICENSE AND 2:00 A.M. BEVERAGE LICENSE FOR THE PERIOD ENDING APRIL 30, 2005, TRANSFERRED FROM SPEEDWAY/SUPERAMERICA, LLC (SUPER AMERICA #4360), SAME ADDRESSES, BE APPROVED, AND THE SAME BE RECOMMENDED TO THE CITY COUNCIL FOR APPROVAL. Mr. McKinnon seconded the motion, and it was unanimously approved.
