BY COUNCILOR GILBERT:
WHEREAS, the Duluth Teachers Credit Union has submitted to the city council a petition to rezone property described as Lots 1-7 and the northerly 11 feet of Lot 8, Block 1, and Lots 1-6, Block 2, Myers and Whipples Addition to Duluth (including requested vacated alley) and located on the southwest corner of Arrowhead Road and Kenwood Avenue; and said petition was duly referred to the city planning commission for a study, report and public hearing, and the city planning commission has subsequently reported its recommendation of denial to the city council; and
WHEREAS, the city planning commission's findings that the requested rezoning classification is inappropriate to protect the comprehensive plan and to conserve and to protect property values in the neighborhood.
NOW, THEREFORE, BE IT RESOLVED, that the petition to rezone the subject properties to allow for a C-1 Commercial Zoning classification is denied based on the following finding:
There are existing traffic flow and traffic congestion problems at the intersection of Kenwood Avenue and Arrowhead Road as well as the intersection of Cleveland Street and Kenwood Avenue. These problems make commercial zoning of this corner inappropriate at this time.
STATEMENT OF PURPOSE: This resolution denies a rezoning petition from the Duluth Teachers Credit Union to change from R-1-c, One-Family Residential District, to C-1 Commercial District, for property located on the southwest corner of Arrowhead Road and Kenwood Avenue.
The Planning Commission recommended approved this action, by a vote of 6-3-1, at its August 25, 2004, meeting. The Planning Staff had recommended approval of the rezoning. (See Companion Ordinance No. 04-054-O.)
