AN ORDINANCE AMENDING CHAPTER 50 OF THE DULUTH CITY CODE 1959, AS AMENDED, ZONING DISTRICT MAP NO. 34 AS CONTAINED IN THE APPENDIX TO CHAPTER 50, TO RECLASSIFY FROM R-1-C, ONE-FAMILY RESIDENTIAL DISTRICT, TO R-3, APARTMENT RESIDENTIAL, CONTIGUOUS PROPERTY LOCATED NORTH OF OHIO STREET, SOUTH OF BUFFALO STREET, EAST OF BROADWAY AVENUE AND WEST OF TRIGGS AVENUE (WILLIAM BURNS, HANFT FRIDE, P.A./COLLEGE OF SAINT SCHOLASTICA).

BY COUNCILOR GILBERT:

The city of Duluth does ordain:

     Section 1. That Plate No. 34 of the zoning district map as contained in the Appendix to Chapter 50 of the Duluth City Code, 1959, is amended to read as follows:

     Section 2. That this ordinance shall take effect and be in force 30 days from and after its passage and publication.


STATEMENT OF PURPOSE:  This zoning ordinance amendment provides a zoning change, from R-1-c, One-Family Residential, to R-3, Apartment Residential District, for vacant lands located west of the College of Saint Scholastica. In addition, the College has requested the streets and alleys in this section of land be vacated to accommodate proposed student housing. (See companion Resolution No. 04-0647R)


The Duluth City Planning Commission recommended approval of this zoning change by a vote of 11 (in favor) and 1 (abstention - Gil Harries), following a public hearing held September 14, 2004, based on the following findings of fact:

     1.)  The area to be rezoned adjoins R-3 zoning

     2.)  This action is part of the College of St. Scholastica’s long range plan to provide apartment rentals to their students.

     3.)  This rezoning implements an objective from the District 10 plan

     4.)  This rezoning does not appear to create potential conflicts with current land use or zoning.
