RESOLUTION TO VACATE PORTIONS OF 53RD AVENUE EAST, WOODLAWN STREET, LESTER STREET AND LESTER ALLEY IN DULUTH (HOUSING AND REDEVELOPMENT AUTHORITY OF DULUTH).

 

BY COUNCILOR GILBERT:

     WHEREAS, a sufficient petition was filed with the city clerk requesting the vacation of the following legally described as: 53rd Avenue East lying between the north line of Woodlawn Alley and the south line of Lester Street (abutting upon Blocks 147-150, 159, and 160, Crosley Park Addition to Duluth); that part of Woodlawn Street lying between the east line of 52nd Avenue East and the west line of 54th Avenue East (abutting upon Blocks 147-150, Crosley Park Addition to Duluth); that part of Lester Alley lying between the east line of 52nd Avenue East and the west line of 54th Avenue East (abutting upon Blocks 149, 150, 159, and 160), Crosley Park Addition to Duluth); and that part of Lester Street lying between the east line of 52nd Avenue East and the west line of 54th Avenue East (abutting upon Blocks 159 and 160, Crosley Park Addition to Duluth, and Lots 32, 33, and 66, Auditor’s Plat of Lester Park Garden Tracts), all in Crosley Park Addition to Duluth and Lester Park Garden Tracts; and

     WHEREAS, pursuant to Section 100 of the City Charter and Article IV of Chapter 45 of the Duluth City Code, 1959 as amended, such petition was duly referred to the city planning commission and such commission gave due notice of public hearing and did consider same in public hearing; and

     WHEREAS, the city planning commission unanimously approved the avenue, streets, and alley vacation at its August 25, 2004, meeting (Reference No. 04083).

     NOW, THEREFORE, BE IT RESOLVED, that the city council of the city of Duluth approves the vacation of 53rd Avenue East, between Woodlawn Alley and Lester Street, Crosley Park Addition; and Woodlawn Street, between 52nd Avenue East and 54th Avenue East, Lester Alley between 52nd Avenue East and 54th Avenue East, and Lester Street, between 52nd Avenue East and 54th Avenue East, retaining the full vacated portion of utility/pedestrian/snowmobile easement along Lester Street, all in Auditor’s Plat of Lester Park Garden Tracts, and as more particularly described on Public Document No. ____________________.

     RESOLVED FURTHER, that the city clerk is hereby directed to record, with the register of deeds and/or the registrar of titles of St. Louis County, Minnesota, a certified copy of this resolution together with a plat showing the portion of the streets, avenue and alley to be vacated.


STATEMENT OF PURPOSE:  This resolution vacates 53rd Avenue East, between Woodlawn Alley and Lester Street, Crosley Park Addition; and Woodlawn Street between 52nd Avenue East and 54th Avenue East; Lester Alley between 52nd Avenue East and 54th Avenue East; and Lester Street between 52nd Avenue East and 54th Avenue East, retaining the full vacated portion of Lester Street as a utility/ pedestrian/ snowmobile easement along Lester Street, all of Auditor’s Plat of Lester Park Garden Tracts.

 

This petition received a unanimous approval of the Duluth Planning Commission at its regular meeting on August 25, 2004.
