AN ORDINANCE AMENDING CHAPTER 50 OF THE DULUTH CITY CODE 1959, AS AMENDED, ZONING DISTRICT MAP NO. 42 AS CONTAINED IN THE APPENDIX TO CHAPTER 50, TO PROVIDE FOR THE RECLASSIFICATION FROM S, SUBURBAN, TO R-1-A, ONE-FAMILY RESIDENTIAL DISTRICT, PROPERTY LOCATED EAST OF WOODLAND AVENUE AND NORTH OF PLEASANT VIEW AVENUE (CARLSON/NELSON).

BY COUNCILOR GILBERT:

The city of Duluth does ordain:

     Section 1. That Plate No. 42 of the zoning district maps as contained in the Appendix to Chapter 50 of the Duluth City Code, 1959, is amended to read as follows:

     Section 2. That this ordinance shall take effect and be in force 30 days from and after its passage and publication.


STATEMENT OF PURPOSE:  This ordinance amendment provides a zoning change, from S, Suburban, to R-1-a, One Family Residential, for properties located east of Woodland Avenue and north of Pleasant View Road in the Woodland neighborhood.


The Duluth city planning commission voted 9-1 to recommend approval of this zoning change following a public hearing held September 22, 2004.


The commission, in recommending the zoning change, made the following findings in support:

1. This rezoning is an expansion of existing R-1-a zone on the east.

2. The rezoning recognizes the existing uses.

3. The rezoning is consistent with the draft housing plan of District 8.


This ordinance should have no effect on the tax base.
